Clerk Plays Dumb with Dump Trucks
Here’s our story~~
We purchased 2 Tonka Trucks that were marked $14.99, the sign above these items said 25% off. After leaving the store I noticed that we were charged $14.99 and did not receive the 25% off.
My husband went back to the store to the Service Desk – they did give the 25% difference. My husband had questioned about the scanner error. Well, the lady at the service counter did not know what the scanner error was. She asked my husband if she should call a manager – he said yes.
When the manager came back she was talking with the other lady who stated she didn’t know what the scanner error was and it sure sounded like she knew what he was talking about. The manager came back and told my husband that the scanner error does not pertain to sale items. We don’t agree with this but the scanner law doesn’t seem to be very clear on this. The scanner should have been programmed to take off the 25%.

You are correct that the scanner law does not seem to be very clear on this particular point. Though we have several readers who have been successful in convincing stores that the law does indeed apply to sale items.
Your sale must comply with the all the requirements set forth in Section 10a: 445.360a of Michigan code. If the sale complies with every point contained in this section, you must be sure that the item you purchased was not specifically listed on the items named, which are explicitly not covered. Tonka Trucks are not on the list!
It has been suggested that you print off the entire law and point out to the store manager that no where in the law does it imply that sale items are exempt from the law. If the store manager does not comply, contact Kohl’s Corporate Office and report them to the attorney general’s office in your area.
