Human Error

Just tonight I was in Meijer’s. Earlier in the week I purchased a PS2 game that was regularly $19.99 but was on sale for $16.82. There was no price on the item, the only way I was aware of the price and sale at all was due to the large yellow sign hanging from the display. When I got home I noticed the error.

Tonight, I double checked the sign to make sure I had seen things correctly. I had. I took my receipt to the service desk and it was still scanning at $19.99, so proceeded to take the service clerk over to the display where she confirmed the error.

However, she would only reimburse me the difference between the regular price and the sales price and gave me a section of the scanner law that talked about sale items and claimed that the scanner law did not apply to “human error”. Is this correct or are they just trying to find a loophole that does not exist? If so, what section would I need to point out to them to prove my rights?

    Just as you suspected the clerk is in error. Meijer has been known to show customers only a portion of the scanner law. The portion of the law you want to show them is Section 445.353 #2 lists the requirements that do not apply, you will see that it says nothing there about “sale items” being exempted.

    In the following item (Section 445.353 #3), gives Meijer the option of not pricing 25 classes of items, this exemption applies to the store, not to customers.

    I recommend you print of a complete copy of the Michigan Scanner Law and take a copy of it with you to the store and show them their error. Others have been successful in getting them to obey the law, once they have had their error pointed out.
