Small Claims Court Case

I thought the original scanner law had a provision that allowed the over charged customer to take the complaint in front of a small claims court judge and there was a mandatory $250.00 award given to the customer if the store manager had refused to pay the 5.00 award???

    Dear Charles,

    The section you are referring to is: Section ยง10: Section 445.360 (2)

    Except as provided in section 10a, a person who suffers loss as a result of a violation of this act may bring an individual or a class action to recover actual damages or $250.00, whichever is greater, for each day on which violations of this act have been found together with reasonable attorneys’ fees not to exceed $300.00 in an individual action.
